Holiday Rental Regulations in Spain: A National Overview

Spain regulates holiday rentals at the regional level, which means rules vary between Andalusia, Catalonia, Valencia, the Balearic Islands, and other autonomous communities. As a property owner, you must comply with both regional and municipal regulations. Ignorance is not a defence, and enforcement has intensified since 2023.

Regional Licence Systems

Every Spanish region requires some form of licence or registration for holiday rentals. The naming conventions differ:

  • Andalusia: VFT (Vivienda con Fines Turísticos)
  • Catalonia: HUT (Habitatge d'Ús Turístic)
  • Valencia: AT (Apartamento Turístico)
  • Balearic Islands: ETV (Estancia Turística en Vivienda)
  • Canary Islands: VV (Vivienda Vacacional)
  • Madrid: VUT (Vivienda de Uso Turístico)

Application processes are broadly similar. You submit a responsible declaration, self-certifying that the property meets minimum standards. Inspections may follow at any time.

Guest Registration: SES.Hospedajes

Since December 2024, all accommodation providers in Spain must register guests through the SES.Hospedajes system operated by the Ministry of Interior. This replaces the old Part de Viajeros system. You must submit guest data within 24 hours of check-in. The required information includes full name, nationality, document number, date of birth, and dates of stay. Non-compliance carries fines from EUR 600 to EUR 30,000.

Platform Obligations

Platforms like Airbnb and Booking.com are required to verify that listings display a valid registration number. In Andalusia, Airbnb blocks listings that lack a VFT number. Platforms also share rental data with the Spanish tax authority (AEAT), so unreported income will be flagged.

Community of Owners Restrictions

Since 2019, Spanish communities of owners (VvE's) can vote to restrict or ban short-term tourist rentals with a three-fifths majority. Before purchasing a property for holiday rental, review the community's statutes and recent meeting minutes. A ban adopted after your purchase still applies to you.

Municipal Zoning Rules

Cities including Barcelona, Palma de Mallorca, Valencia, and Malaga have introduced zoning restrictions that limit or ban new holiday rental licences in certain areas. These rules change frequently. In some zones, no new licences are issued at all. In others, licences are only granted to properties meeting specific criteria (separate entrance, minimum size, maximum density per building).

Tax Obligations

Holiday rental income is subject to income tax (IRPF for residents, modelo 210 for non-residents). Some regions have introduced a tourist tax. In Catalonia, this ranges from EUR 0.65 to EUR 3.50 per night depending on the accommodation type and location. Andalusia has discussed but not yet implemented a tourist tax.

Penalties for Non-Compliance

Fines for operating without a licence vary by region:

  • Andalusia: EUR 2,000 to EUR 150,000
  • Catalonia: EUR 3,000 to EUR 600,000
  • Balearic Islands: EUR 20,000 to EUR 400,000
  • Valencia: EUR 10,000 to EUR 600,000

Enforcement is increasingly proactive. Authorities use web scraping to identify unlicensed listings and cross-reference platform data with licence registries. The risk of operating illegally is no longer theoretical.

Staying Compliant

  • Obtain the correct regional licence before listing
  • Display your registration number on all platforms and advertising
  • Register every guest through SES.Hospedajes within 24 hours
  • Declare all rental income and pay applicable taxes quarterly
  • Check your community of owners' rules annually for any changes
  • Monitor municipal regulations for new zoning restrictions
