What Is a Power of Attorney (Poder) in Spain?

A power of attorney (poder notarial) is a legal document that authorises someone to act on your behalf. For property purchases, it lets your lawyer sign contracts, make payments, and complete the entire transaction without you being physically present in Spain. It is essential for remote buyers and highly convenient for everyone else.

Types of Power of Attorney

There are two main types:

General Power of Attorney (Poder General)
Grants broad authority to act on your behalf in many matters, not just property. Useful if you need someone to handle multiple affairs in Spain (banking, tax, legal). Carries more risk because the scope is wide.

Specific Power of Attorney (Poder Especial)
Limited to specific actions, such as purchasing a named property at a stated price. This is what most property lawyers recommend. It protects you because the representative cannot do anything beyond what the document specifies.

For property purchases, always use a specific poder that names the property address or catastral reference and the maximum purchase price. This limits your exposure.

Where to Get a Power of Attorney

Option 1: At a Spanish Notary

If you are in Spain, any notario can prepare and notarise the poder. The process takes about an hour. Cost: 50-100 EUR. This is the fastest and cheapest option. You will need your passport and NIE number.

Option 2: At a Spanish Consulate Abroad

If you are in the Netherlands, the UK, or another country, visit the nearest Spanish consulate. Book an appointment in advance as wait times can be long. The consular officer acts as notary. Cost: 50-150 EUR. The document is immediately valid in Spain.

Option 3: At a Local Notary with Apostille

You can execute the poder at a notary in your home country, but it must then be apostilled (a form of international certification under the Hague Convention) and translated into Spanish by a sworn translator. This adds cost (200-400 EUR total) and time (1-2 weeks). Only use this option if a Spanish consulate is not accessible.

What Powers to Include

A well-drafted poder for property purchase should authorise your representative to:

  • Sign the reservation contract and pay the deposit
  • Sign the arras (private purchase contract) and pay 10%
  • Sign the escritura at the notary
  • Sign the mortgage deed (if applicable)
  • Apply for your NIE on your behalf
  • Open or operate a Spanish bank account
  • Pay taxes and fees related to the purchase
  • Submit documents to the Land Registry
  • Connect utilities in your name

How to Revoke a Power of Attorney

You can revoke a poder at any time by visiting any Spanish notary (or consulate) and signing a revocation document. The revocation is then recorded in the notarial registry. Always revoke the poder once the transaction is complete, especially if it was a general power of attorney.

Common Mistakes with Powers of Attorney

  • Making it too broad: A general poder gives excessive authority. Always use a specific one for property transactions.
  • Not including all needed powers: If the poder does not mention mortgage signing and you need a mortgage, the notary will refuse to proceed.
  • Forgetting to apostille: A poder signed outside Spain without an apostille is invalid in Spain.

  • Granting to the wrong person: Always grant the poder to your independent lawyer, never to the estate agent or the seller's representative.

Do You Actually Need One?

If you plan to be in Spain for every stage of the process, including the notary signing, you technically do not need a poder. However, most experienced buyers get one anyway as a backup. If your flight is cancelled or you fall ill on signing day, the poder means the transaction still completes on schedule. For a cost of 50-100 EUR, it is sensible insurance.
