Buying in Spain Without a Mortgage

About 40% of foreign property purchases in Spain are cash transactions. Paying without a mortgage simplifies the process, speeds up completion, and gives you stronger negotiating power. But there are important considerations that cash buyers often overlook.

Advantages of a Cash Purchase

  • Faster completion: Without a mortgage, you can complete in 2-4 weeks instead of 6-8
  • Negotiating leverage: Sellers prefer cash buyers and may accept 5-10% less
  • Lower costs: No mortgage arrangement fees, no valuation fee, no tied products
  • Simpler process: No bank approval, no FEIN, no cooling-off period for mortgage terms
  • No monthly debt: Full ownership from day one

What You Still Need

Even without a mortgage, certain requirements remain:

  • NIE number (mandatory for any property transaction in Spain)
  • Spanish bank account (the notary transfers funds through Spanish accounts)
  • Lawyer (strongly recommended, even more so without a bank's due diligence)
  • All standard taxes and fees still apply

Transferring Large Sums to Spain

Moving 200,000-500,000+ EUR to Spain requires planning:

  • Use a currency exchange specialist (TransferWise/Wise, Currencies Direct, or similar). They typically offer 0.3-0.5% better rates than banks, which on large sums means savings of 1,000-2,500 EUR.
  • Notify your home bank in advance about large outgoing transfers to avoid security blocks.
  • Consider splitting the transfer into stages: reservation deposit, arras payment, then the balance.
  • Keep records of every transfer for anti-money-laundering compliance.

Tax Implications

Cash purchases can attract extra scrutiny from Spanish tax authorities. Be prepared to demonstrate the legal source of funds. You may need:

  • Bank statements showing savings accumulation
  • Proof of property sales in your home country
  • Evidence of inheritance or investment returns
  • Tax returns confirming declared income

Spanish law requires the notary to verify the source of funds. Transactions over 100,000 EUR in cash (physical notes) are prohibited. All payments must go through bank transfers.

The Due Diligence Gap

When a bank finances a purchase, they independently verify the property: legal checks, title search, and professional valuation. Cash buyers miss this safety net. Your lawyer must fill this gap. Budget 1,500-3,000 EUR for thorough legal due diligence including:

  • Nota simple verification (current ownership and charges)
  • Urban planning compliance check
  • Community of owners debt check
  • Energy performance certificate
  • Utility connection verification
